ANSFISA has adopted, through a specific decree, the “Guidelines for estimating, evaluating and managing the risk associated with the transport of dangerous goods by rail”, developed within a working group coordinated by the technical mission structure of the Ministry of Infrastructure and Transport, with the participation of the Higher Council of Public Works and other structures of the Ministry of Infrastructure and Transport competent in matters of rail transport. The version adopted also takes into account the observations received in the context of the public consultation launched by ANSFISA.

The Guidelines are not binding but identify a methodology for calculating the risk levels of railway sections affected by the transport of dangerous goods and propose limits of acceptability and attention of quantitative risks (directly derived from the Ministerial Decree of 28 October 2005 on the safety of railway tunnels) and qualitative risks (also reported in the CEI-EN 50126-1: 2018-04 standards); they also provide indications for the implementation of the decision-making process for the management of risks associated with the transport of dangerous goods in accordance with the criteria and principles outlined in the “Risk Management Framework for inland transport of dangerous goods”, published in 2018 on the ERA website and developed within the UNECE by the European Union Agency for Railways.

The document is in line with the Implementing Regulation (EU) no. 402/2013 of the Commission of 30 April 2013, relating to the common safety method for the determination and assessment of risks, which in Annex I, point 2.1.4., letter c), identifies the accurate estimation of risks as one of the evaluation criteria that can be used to determine the acceptability of the same risk and, in point 2.5.2, provides that the acceptability of the estimated risks must be assessed on the basis of the criteria established by Union legislation or by notified national standards.
